Troll Jason Fortuny Defends Craigslist Lawsuit with "Fair Use" Argument

Fortuny is now being sued for violation of privacy and copyright infringement (he posted a photo of the guy that he did now own). Fortuny is defending himself and argues in a letter to the judge that his publication of the image was "fair use".
The comments that follow in the ValleyWag post are very much to the point of why the MBA wants to educate bloggers on the basic of media law. These folks have no clue about "fair use" but are offering all sorts of opinions and bad advice.

Anyone want to set the record straight on fair use? I'm more interested in the fair use of publicly available images. I think this guy might have a problem because the images were provided for personal use. But in what cases could you use a public, copyrighted image and not pay the author?
