Ignore Web Site TOS, Go to Prison?
The EFF has filed an Amicus Brief asking that charges be dismissed in the highly controversial Lori Drew/MySpace case, a decision sure to cause a backlash against the civil rights group. The EFF is concerned that if the court upholds the prosecutions claim that Drew committed a crime by violating the Terms of Service of MySpace by lying about her identity it will turn millions of Internet users into criminals since so few read the TOS for web sites (or software, for that matter).
The EFF, a prominent voice in Web advocacy, said in a release Monday that 'criminal charges for a 'terms of service' violation is a dramatic misapplication of the CFAA (Computer Fraud and Abuse Act), with far-ranging consequences for American computer users".
